You must read and accept the Terms and Conditions before you access and use the Wi-Fi service (hereafter referred to as the "WallaceWiFi"). By accessing and using WallaceWiFi you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions, please do not access and/or use WallaceWiFi
Use of the WallaceWiFi
The User undertakes:-
- Not to use WallaceWiFi for any unlawful purpose;
- That it shall not make any use of WallaceWiFi such that the whole or part of WallaceWiFi is interrupted, damaged, rendered less efficient, or the effectiveness or functionality of WallaceWiFi is in any way impaired;
- Not to use WallaceWiFi for the transmission or posting of any computer viruses or any material which is defamatory, offensive or of an obscene or menacing character or in such a way as to cause annoyance, inconvenience or needless anxiety;
- Not to use WallaceWiFi in a manner which constitutes a violation or infringement of the rights of any person, firm or company (including rights of copyright or confidentiality);
- That it shall not use WallaceWiFi for any commercial purposes or to transmit any material for the purposes of publicity, promotion and/or advertising;
- That in the event that it has any right, claim or action against any other User arising out of the use of WallaceWiFi then it shall pursue such right, claim or action independently of, and without recourse to, the Wallace Collection; and
- That the Wallace Collection may block access to certain websites by you on the WallaceWiFi, including for example certain high bandwidth websites, in order to share bandwidth more amongst its User group.
- The User will indemnify and defend the Wallace Collection against all claims, liability, damages, costs and expenses, including legal fees, arising out of a breach of these Terms and Conditions or any Use of the WallaceWiFi by the User. The User acknowledges the internet is a global electronic network and the Wallace Collection is not responsible for the accuracy, validity, legality or usefulness of information available, or any viruses and software designed to damage equipment and networks, which you may encounter while connected to WallaceWiFi. The User agrees to fully indemnify the Wallace Collection against any claims or legal proceedings arising in connection with User's use of WallaceWiFi which are brought or threatened against the Wallace Collection by any other person.
Definitions
"Information" means all material delivered by the Wallace Collection through WallaceWiFi. "User" means you, the WallaceWiFi end-user. "Terms and Conditions" means this WallaceWiFi agreement.
Warranty
WallaceWiFi is provided on an "as is" and "as available" basis and the Wallace Collection makes no warranties or representations whether express or implied in relation to the Information, including implied warranties or conditions of completeness, accuracy, satisfactory quality or fitness for a particular purpose.
Liability
WallaceWiFi is provided on an "as is" and "as available" basis and the Wallace Collection makes no warranties or representations whether express or implied in relation to the Information, including implied warranties or conditions of completeness, accuracy, satisfactory quality or fitness for a particular purpose.
Intellectual Property
The User acknowledges that all copyright, trade marks and all other intellectual property rights in the WallaceWiFi shall remain vested in the Wallace Collection or its licensor.
Suspension and Termination
The Wallace Collection shall have the right to immediately terminate these Terms and Conditions and/or suspend WallaceWiFi if the User commits a breach of the Terms and Conditions.
User Data
The Wallace Collection will deal with your personal data in compliance with the current data protection legislation in England and in accordance with The Wallace Collection Privacy Policy.
The Wallace Collection cannot guarantee the security or privacy of WallaceWiFi and any information or communication to or from WallaceWiFi by the User.
Changes to the Terms and Conditions
The Wallace Collection reserves the right to change these Terms and Conditions from time to time by placing a note of such change in this file. The User's continued use of WallaceWiFi following notice of such change shall be deemed to be the User's acceptance of any such change. It is the User's responsibility to check this file regularly to determine whether these Terms and Conditions have been changed. If the User does not agree to any change to these Terms and Conditions then the User must immediately stop using WallaceWiFi
Severability
Each provision of these Terms and Conditions excluding or limiting liability shall be construed separately, applying and surviving even if for any reason one or other of those provisions is held inapplicable or unenforceable in any circumstances and shall remain in force notwithstanding the termination of these Terms and Conditions howsoever occasioned.
No Waiver
No waiver by the Wallace Collection shall be construed as a waiver of any breach of any provision of these Terms and Conditions.
Choice of Law
These Terms and Conditions shall be governed by English law and the parties hereby irrecoverably submit to the exclusive jurisdiction of the English Courts.

Fair Usage Policy
So that we can offer all users of our WiFi system a reliable, smooth service, we have in place a Fair Usage Policy. We reserve the right to restrict a user's connection speed, or terminate their session, if the level of use is deemed by us as excessive and therefore to detrimental to other users. While the vast majority of users will use far less, we determine that any usage of the service above 40Mb per hour is classed as excessive and subject to restriction or termination of session.
